Article 1: General provisions The e-commerce website of Zinder, a company with registered office at Hundelgemsesteenweg 409 301, 9820 Merelbeke, VAT BE0791829707, [email protected], offers its customers the opportunity to purchase products from its online store online. These General Terms and Conditions ("Terms") apply to every order placed by a visitor to this e-commerce website ("Customer"). When placing an order via Zinder's online store, the Customer must expressly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions, to the exclusion of all other terms and conditions. Additional terms and conditions of the Customer are excluded, unless they have been accepted in advance, in writing and expressly by Zinder. Article 2: Price All prices stated are expressed in EURO, always including VAT and all other duties or taxes required to be paid by the Customer. Zinder is currently a small company and is therefore exempt from VAT. Shipping costs are charged separately and this will be reported at Check-out. The price statement applies exclusively to the items as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.
Article 3: Offer Despite the fact that the online catalog and the e-commerce website are included with the utmost care, it is still possible that the information provided is incomplete, contains material errors, or is not up to date. Obvious errors in the offer recorded Zinder did not. Zinder means that the accuracy and completeness of the information provided only constitutes an obligation of means. Zinder is under no circumstances liable in the event of manifest material errors, typesetting or printing errors. If the Customer has specific questions about, for example, sizes, color, availability, delivery time or delivery method, we require the Customer to contact our customer service in advance. Article 5: Delivery and execution of the agreement Orders are processed and shipped within 5 working days, unless otherwise stated. After shipment you will receive a Track and Trace code with which you can track the shipment after shipment. Items ordered via this online store are delivered in Belgium. Other countries are not currently part of the sales market. Delivery is done by Bpost. The current standard shipping cost for packages of 5.70 euros will be charged at check out. Any visible damage and/or qualitative shortcoming of an item or other shortcoming during delivery must be reported by the Customer to Zinder immediately. The risk for loss or damage is transferred to the Customer as soon as he has acquired physical possession of the goods. However, the risk is already transferred to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by Zinder.
Article 6: Retention of title The delivered items remain the exclusive property of Zinder until full payment has been made by the Customer. If necessary, the Customer undertakes to inform third parties of Zinder's retention of title, for example to anyone who would seize items that have not yet been fully paid for.
Article 7: Right of withdrawal The provisions of this article only apply to Customers who purchase items online from Zinder in their capacity as consumers. The Customer has the right to withdraw from the agreement within a period of 14 calendar days without giving reasons. Zinder may ask you for feedback, with a view to future customer prospects, but you are not obliged to provide a response. The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, acquires physical possession of the good. To exercise the right of withdrawal, the Customer must inform Zinder of his decision to withdraw from the contract by an unequivocal statement (e.g. in writing, preferably by e-mail). The Customer can use the attached model withdrawal form for this, but is not obliged to do so. The Customer can also complete and send the model withdrawal form or another clearly formulated statement electronically via our website www.zindercaps.be. If the Customer makes use of this option, we will immediately send the Customer confirmation of receipt of his withdrawal on a durable data carrier (e.g. by e-mail).
In order to comply with the withdrawal period, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.
The Customer must return or hand over the goods to Zinder without delay, but in any case no later than 14 calendar days after the day on which he communicated his decision to withdraw from the agreement to Zinder. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.
The direct costs of returning the goods are borne by the Customer.
The Customer is requested to return the articles in their original condition and packaging, with all accessories and instructions supplied with them. If the returned product has been diminished in value in any way, Zinder reserves the right to hold the Customer liable and claim compensation for any diminished value of the goods resulting from the Customer's use of the goods that goes beyond what is necessary to determine the nature, characteristics and functioning of the goods.
All returned items will be carefully examined. The starting point here is that the consumer may only inspect the item as he would be allowed to do in a shop. Returned items may be tried on, but may not have been used. If an item has suffered a decrease in value due to the Customer's use, this will be charged to the Customer.
Any additional costs resulting from the Customer's choice of a method of delivery other than the cheapest standard delivery offered by Zinder will not be reimbursed.
Zinder will reimburse the Customer using the same payment method with which the Customer made the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged any costs for such reimbursement.

Article 8: Warranty
Pursuant to Article 1649quater of the old Civil Code, the consumer has statutory rights. This statutory warranty lasts for two years and applies from the date of delivery to the first owner. Any commercial warranty does not affect these rights.
In order to invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.
For items purchased online and delivered to the Customer's home, the Customer must contact customer service.
If a defect is discovered, the Customer must inform Zinder as soon as possible. In any case, any defect must be reported by the Customer within 2 months of its discovery. After that, any right to repair or replacement will lapse.
The (commercial and/or legal) guarantee never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, adjustments or modifications to the article, rough handling, poor maintenance, or any other abnormal or incorrect use.

Article 10: Sanctions for non-payment
Without prejudice to the exercise of other rights available to Zinder, in the event of non-payment or late payment, the Customer shall owe, by operation of law and without notice, an interest of 10% per year on the unpaid amount from the date of default. In addition, the Customer shall owe, by operation of law and without notice, a fixed compensation of 10% on the amount in question, with a minimum of 25 euros per invoice.
Without prejudice to the foregoing, Zinder reserves the right to take back the articles that have not been (fully) paid for.
Article 11: Privacy
The controller, Zinder, respects the General Data Protection Regulation and the Belgian Privacy Act of 30 July 2018.
The personal data you provide will only be used for the following purposes: specifying the purposes for which the data is processed, such as the execution of the concluded agreement, processing the order, sending newsletters, advertising and/or marketing purposes. The legal grounds are the execution of the agreement, consent, fulfilling legal and regulatory obligations and/or the legitimate interest of the company.
You have a legal right to inspect and possibly correct, supplement or delete your personal data. In a number of cases listed in the GDPR, you may also request that the processing of your personal data be limited. You can also object to the processing of your personal data if you have serious and legitimate reasons for doing so that exceed our need to process your data. By means of a written, dated and signed request to Zinder, you can request your personal data in digital and readable form free of charge and/or have it transferred to other responsible parties. Insofar as our processing is based on your prior consent, you have the right to withdraw that consent.
In the event of use of data for direct marketing: You can object to the use of your data for direct marketing free of charge and do not have to give a reason for this.

Article 14: Amendment of conditions
These Conditions are supplemented by other conditions to which explicit reference is made, and the general sales conditions of Zinder. In the event of a conflict, these Conditions shall prevail.
Article 15: Evidence
The Customer accepts that electronic communications and backups may serve as evidence.
Article 16: Applicable law – Disputes
Belgian law applies, with the exception of the provisions of private international law regarding applicable law.
The courts of the Consumer's place of residence have jurisdiction in legal disputes. The Consumer can also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).
